The Walmart trucker responsible for the crash that critically injured comedian Tracy Morgan and killed another man was driving 20 miles per hour over the speed limit at the time of the crash, according to the National Traffic Safety Board (NTSB). In addition, the driver had been on duty for nearly the 14-hour limit at the time of the crash. He has been charged with vehicular homicide and assault.
According to the NTSB, it does not appear that the driver violated any Hours of Service regulations prior to the incident.
A criminal complaint alleged that the driver had not slept in the 24 hours leading up to the crash, leaving some to believe that he may have been overly fatigued.
